Acceptable Use Policy (AUP)

Applicable NexSara Entity

If you use NexSara in India, the applicable NexSara entity is Fiidus Solutions Private Limited, which operates the NexSara platform and brand in India.

For users outside India, unless otherwise stated, the applicable NexSara entity is NexSara LLC.

This Acceptable Use Policy (“AUP”) governs permitted and prohibited uses of the NexSara platform, website, and related digital services (collectively, the “Platform”).

This policy applies to all users, including Customers and Service Providers.

This AUP is incorporated by reference into the NexSara Terms of Service and Service Provider Agreement. Violation of this policy may result in suspension, termination of access, revocation of verification status, or other enforcement actions.

1. Permitted Use

Users may access and use the NexSara Platform solely for lawful purposes related to:

• Discovering service professionals
• Offering legitimate professional services
• Communicating with other users for service-related purposes
• Engaging in marketplace activities consistent with NexSara policies

All use of the Platform must comply with applicable laws and these policies.

2. Prohibited Conduct

Users may not engage in conduct that undermines platform safety, trust, or integrity.

Prohibited activities include, but are not limited to:

• Providing false, misleading, or fraudulent information
• Uploading falsified identity or verification documents
• Impersonating another person, business, or entity
• Engaging in harassment, discrimination, threats, or abusive behavior
• Posting illegal, harmful, or deceptive content
• Violating intellectual property rights
• Attempting to hack, disrupt, damage, or reverse engineer the Platform
• Circumventing platform safeguards, security measures, or verification systems
• Facilitating illegal services or unlawful transactions
• Misusing or exploiting personal data of other users
• Misrepresenting qualifications, licenses, certifications, insurance coverage, business affiliations, or verification status;
• Using artificial intelligence, automation tools, or other technologies to generate deceptive, fraudulent, or misleading content;
• Attempting to manipulate search rankings, marketplace visibility, reviews, ratings, inquiries, or platform metrics;
• Using the Platform to send unsolicited marketing communications, spam, or unrelated commercial solicitations.

3. Fraud & Financial Abuse

Users may not engage in fraudulent or deceptive financial practices, including:

• Accepting payment and failing to deliver agreed services
• Payment scams or deceptive payment requests
• Manipulating reviews, ratings, or feedback
• Identity fraud or impersonation
• Facilitating money laundering, financial fraud, or illegal financial activity
• Chargeback abuse or unauthorized payment disputes;
• Circumventing subscription fees, platform billing requirements, or paid feature restrictions;
• Fraudulent use of promotional offers, discounts, credits, or referral programs.

NexSara may cooperate with law enforcement authorities in investigating fraudulent activity.

4. Platform Integrity & Abuse

Users may not attempt to manipulate, exploit, interfere with, or undermine the Platform through technical, operational, or deceptive means, including:

• Using automated scripts, bots, crawlers, scraping tools, or similar technologies to extract Platform data;
• Harvesting user contact information without authorization;
• Creating duplicate, fraudulent, misleading, or unauthorized accounts;
• Attempting to evade platform enforcement actions;
• Circumventing verification processes, security controls, or platform safeguards;
• Creating accounts for the purpose of artificially increasing visibility, ratings, reviews, inquiries, marketplace activity, or other platform metrics;
• Interfering with the normal operation, performance, security, availability, or integrity of the Platform; and
• Using automated systems, artificial intelligence tools, bots, or scripts to generate fake inquiries, reviews, ratings, messages, interactions, or other misleading activity.

Unauthorized automated access to the Platform is strictly prohibited.

4.1 Artificial Intelligence and Automated Systems

Users may use artificial intelligence and automation tools to assist with legitimate business activities, provided such use complies with NexSara policies, applicable law, and generally accepted standards of professional conduct.

Users may not use artificial intelligence, automation, bots, scripts, or similar technologies to:

• Generate misleading, deceptive, fraudulent, or unlawful content;
• Create fake profiles, inquiries, reviews, ratings, messages, or interactions;
• Impersonate individuals, businesses, organizations, or other users;
• Circumvent platform safeguards, security controls, verification systems, or enforcement actions; or
• Engage in spam, harassment, fraud, manipulation, or other prohibited conduct.

NexSara reserves the right to restrict, limit, suspend, or prohibit automated activities that negatively impact users, platform integrity, security, performance, availability, or marketplace operations.

5. Enforcement Rights

To protect marketplace integrity, NexSara reserves the right to take enforcement action where violations are suspected or confirmed.

Such actions may include:

• Removing or restricting content
• Issuing warnings
• Temporarily suspending accounts
• Revoking verification status
• Permanently terminating platform access
• Reporting unlawful activity to law enforcement or regulatory authorities
• Restricting access to specific platform features;
• Downgrading, restricting, or removing subscription-related benefits
• Removing provider listings or limiting marketplace visibility

Enforcement decisions are made at NexSara’s sole discretion and are intended to protect the safety and integrity of the Platform.

Such enforcement actions do not constitute legal determinations of liability or fault.

6. Reporting Violations

Users may report suspected violations of this policy by contacting NexSara at:

Reports may be reviewed to determine whether platform policies have been violated.

7. Relationship to Other Policies

This Acceptable Use Policy should be read together with:

In the event of any conflict, the Terms of Service and Service Provider Agreement shall govern.

8. Jurisdiction and Legal Compliance

NexSara operates a global digital services marketplace headquartered in the United States.

Users are responsible for ensuring that their activities on the Platform comply with all applicable laws, regulations, and licensing requirements in their jurisdiction.

Nothing in this policy shall be interpreted as NexSara providing regulatory supervision, certification, or legal compliance oversight.

9. No Waiver

Failure by NexSara to enforce any provision of this Acceptable Use Policy shall not constitute a waiver of its right to enforce that provision or any other provision in the future.
